Baby Carrier Rental Service - Terms and Conditions

These terms and conditions, and the associated Cloth and Carry Baby Carrier Hire Service Rental Agreement, are subject to change without notice. 

Rental Period:  

The rental period begins on the Start Date and ends on the End Date, as specified in the individual Rental Agreement.  

Rental Fees:  

The Renter agrees to pay Cloth and Carry the specified rental fee in advance, as outlined in the Rental Agreement. This fee is non-refundable.  

  • Postage fees must be paid for postage both to the Renter and for returns to Cloth and Carry.  
  • If the Renter applies and is approved to buy the rental equipment, only the return postage fee and the upfront Rental Fee will be credited towards the purchase – the original postal fee to send the carrier to the Renter will not be credited or refunded in any way.  
  • A security deposit will be charged for all rentals; see below.  
  • Rental fees are defined by Cloth and Carry management and are subject to change without notice.  
  • Rental fees cannot be paid using Afterpay.  
  • Late returns may incur additional charges at a rate of $5/day. Non-payment may result in a debt collection agency being engaged and possible police charges.  

Security Deposit:  

The Renter shall provide a security deposit as specified in the Rental Agreement, payable at the beginning of the rental period. The security deposit is automatically added to the cart upon payment of the hire fees.  

  • This deposit will be refunded to the Renter upon the return of the equipment in the same condition as received, less any deductions for damage, loss, or other charges (for example return postage). The total replacement fee can be found in the Baby Carrier Hire Agreement.  

Replacement Fee:  

The Renter understands that they are liable to pay a Replacement Fee if the rental equipment is not returned within 28 days of the end date in the Rental Agreement or is returned in a state that is deemed to be unacceptable for future use.  

  • The replacement fee of each item of rental equipment will be defined by the recommended retail price of the product like for like, regardless of the age of the rental equipment hired.  
  • The replacement fee will be charged, as per the Replacement Fee defined in the Rental Agreement.  
  • The Security Deposit will be used to cover this charge, and the Renter agrees to pay the remainder of the fee within 48 hours of receipt of an invoice for the replacement of the rental equipment. 

Postage and Collection:  

  • The Renter is responsible for paying the return tracked postage fees within the timeframe stated in the Rental Agreement. If postage is arranged by the Renter, they agree to promptly provide tracking information to Cloth and Carry.  
  • The Renter must ensure that the rented equipment is packaged safely and scanned into the Australia Post parcel system on or before the End Date specified in the Rental Agreement.  
  • If the rental equipment is not returned within the timeframe specified in the Rental Agreement, the security deposit will be withheld and further charges may be applied for replacement of the rental equipment - see Loss and Damages.  
  • The Renter may elect to collect from and return the rental equipment to the Cloth and Carry home showroom in Beeliar, Western Australia. This must be pre-arranged at least 12 hours in advance, and within the timeframe stated in the Rental Agreement.  

Equipment Available for Hire:  

  • Cloth and Carry has a large range of products for sale and hire, including but not limited to:  
  • Stretchy Wraps  
  • Woven Wraps  
  • Hybrid Newborn Carriers  
  • Ring Slings  
  • Full Buckle Carriers  
  • Half Buckle Carriers  
  • Meh Dais  
  • Strap Protector Suck Pads  
  • All rental equipment remains the property of Cloth and Carry for the duration of the Rental Period unless a purchase agreement is arranged and any associated purchase invoice paid in full.  
  • The Renter can apply to buy the rental equipment by emailing Cloth and Carry. The Rental Fee, Security Bond and Return Postage* payments made for that specific product/s will be deducted from the purchase price.  
  • *If there are other rental products included in the Rental Agreement that the Renter wishes to return to Cloth and Carry at the end of the Rental Agreement period, the Return Postage will not be deducted from the purchase price.  

Use and Care of Equipment:  

  • The Renter agrees that they are physically, mentally and medically capable of using the rental equipment, and that their child meets the minimum recommendations for the specific equipment hired.  
  • The Renter agrees to use the rental equipment safely and strictly only for its intended purpose and in accordance with the manufacturer's instructions and any associated laws.  
  • TICKS babywearing safety must also be adhered to at all times. If you are unsure at any time, please contact Cloth and Carry with photos, videos and/or questions.  
  • The equipment must not be modified, altered, or repaired without the prior written consent of a Cloth and Carry representative.  
  • The Renter agrees to make every attempt possible to avoid the carrier coming into contact with smoke, pet hair and strongly scented fragrances.  
  • No animals are to be worn in Cloth and Carry rental equipment. 

Maintenance and Cleaning:  

  • The Renter shall return the equipment in the same clean and well-maintained condition as received. Failure to do so will result in a cleaning or maintenance fee, and may result in additional costs for damage/replacement (see below).  
  • The Renter is required to contact Cloth and Carry for written permission and specific washing instructions in the instance that rental equipment requires cleaning.  
  • Specific carriers and manufacturers have different washing instructions which must be respected in order to limit risk of damage to rental equipment.  
  • Cloth and Carry requests that IF washing permission is granted, the Renter follows all written and verbal instructions including but not limited to placing baby carriers inside a garments bag or pillowcase with all buckles fastened, using a low spin speed and sensitive liquid detergent, and strictly NO fabric conditioners.  
  • No Cloth and Carry rental equipment can be dried in a tumble-dryer. Line-drying in the shade is essential to protect the integrity of the baby carriers.  
  • The Renter agrees to spot clean only without abrasive equipment or detergents unless prior discussion with Cloth and Carry management.  
  • Structured carriers will be loaned with suck pads:  
  • Suck pads are fitted to the shoulder straps to prevent damage to the carrier from children chewing on the straps, dribbling, vomit and excessive washing.  
  • Suck pads can be washed with the Renter’s normal washing.  
  • These must be returned with all rental equipment.  
  • Failure to return the suck pads will result in the replacement cost being deducted from the Security Bond.  
  • The Renter understands that rental equipment does not need to be washed prior to return.  

Loss or Damage:  

  • All rental equipment is checked prior to being released to the Renter, and is loaned in a safe, undamaged condition.  
  • The Renter is responsible for any loss, theft, or damage to the equipment during the rental period. In the event of loss or damage, the cost of repair or replacement (as per the replacement fee defined in the Rental Agreement, regardless of the age of the rental equipment) will be deducted from the security deposit. If the cost exceeds the security deposit, the Renter agrees to pay the additional amount within 10 business days of invoicing.  
  • The Renter must check buckles, stitching and accessories before every use and avoid damaging the carrier with items including but not limited to jewellery, Velcro or sharp objects.  
  • The Renter will not attempt to repair any part of a Cloth and Carry rental product, and will not engage a third party to do so. Damaged carriers must be returned to Cloth and Carry for formal assessment, to ensure that the carrier’s integrity and strict safety regulations are maintained.  
  • The Renter must promptly report any damage or loss to Cloth and Carry. 

Cancellation:  

  • The Renter may cancel the Agreement before the rental period begins. The rental fee is non-refundable, but the security deposit and any postage fees paid will be refunded if the cancellation is made at least 7 days before the rental period begins AND before the equipment has been shipped, as specified in the Agreement.  
  • Cloth and Carry representatives reserve the right to cancel a rental request prior to the beginning of the rental period and refund all amounts paid.  

Liability:  

  • The Renter agrees to use the equipment at their own risk.  
  • Cloth and Carry and all its representatives shall not be held liable for any injuries, accidents, or damages that may occur while using the rental equipment, included but not limited to the use of the equipment itself, advice given during online and in-person fittings, and any recommendations provided.  
  • The Renter is responsible for ensuring the safety and comfort of the child and adequate ergonomics and adjustments for all parties while using the baby carrier.  
  • The Renter is responsible for checking the integrity of the equipment prior to every use, and agrees to notify Cloth and Carry immediately if any damage or loss is noticed during any part of the rental period.  
  • The Renter is responsible for ensuring that all people wearing and worn in a Cloth and Carry baby carrier are medically fit and capable of using a baby carrier safely.  

Indemnity: 

You agree to indemnify, defend and hold harmless Alyce Mostert and all affiliates, partners, contractors, service providers, subcontractors, suppliers, and employees of Cloth and Carry or Alyce Mostert - Early Parenting Educator, from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

Communication:  

  • Cloth and Carry will contact the Renter primarily by email or text message regarding the Rental conditions, postage/tracking, returns, overdue notices and additional fees/charges.  
  • If the Renter does not receive a confirmation email within 30 minutes of placing a booking to hire a carrier through the Cloth and Carry website, we ask that you please check your junk mail folder and if there is still no email from us, please contact shop@clothandcarry.com.au to confirm your details are correct and that the Rental order has been received.  
  • The Renter agrees to inform Cloth and Carry of any changes to their contact details at their earliest convenience, including name, email address, postal address, residential address and phone number. 

Availability and Rental Periods:  

  • All hire items are rented out subject to availability, condition and suitability.  
  • A maximum of two carriers can be hired at any one time.  
  • The standard rental period is two or three weeks, chosen at checkout by the Renter and paid in advance.  
  • If a longer or shorter hire period is required, please contact shop@clothandcarry.com.au to arrange Special Rental Agreement and appropriate billing changes.  
  • An extension to the original hire period may be approved at the discretion of Cloth and Carry management, with appropriate upfront payment of extension fees required.  
  • The maximum hire period for any given carrier including extensions is 10 weeks, after which all rental equipment must be returned to Cloth and Carry.  

Rental Period Extensions  

  • The Renter may request to extend their Rental Period , up to a maximum of ten weeks consecutive hire.  
  • The Renter must contact Cloth and Carry at least 24 hours BEFORE the end of the Rental Period to request an extension, and all invoices for extension fees must be paid before the end of the Rental Period.  
  • Extensions will only be granted pending carrier availability.  

Late Fees  

  • The Renter understands that timely return of rental equipment is important for the ongoing success of the Cloth and Carry Baby Carrier Hire Service.  
  • LOCAL: All rental equipment must be placed in the returns bin at Cloth and Carry by 5pm on the final day of the Rental Period, as recorded in the Rental Agreement.  
  • ELSEWHERE: All rental equipment requiring postage must be packaged appropriately and scanned into the Australia Post parcel system on or before the End Date specified in the Rental Agreement.  
  • If the rental equipment is not returned within the timeframe specified in the Rental Agreement, the security deposit will be withheld and further charges may be applied for replacement of the rental equipment - see Loss and Damages.  
  • Late returns will incur additional charges at a rate of $5/day.  
  • These will be charged to the Renter in bulk every 14 days.  
  • After 28 days of non-return, the rental equipment will be assumed lost to Cloth and Carry, and the Renter will be charged the full replacement value of all rental equipment in their possession or the late fees accrued whichever is the larger value.  
  • All rental fees are non-refundable, including late fees and replacement costs charged, and will not be refunded if the carrier is returned after the final overdue payment has been received.  
  • Non-payment beyond 56 days will result in a police report and a debt collection agency being engaged. 

Apply to Buy  

The Renter can apply to buy the rental equipment by emailing: shop@clothandcarry.com.au 

  • All rental equipment remains the property of Cloth and Carry for the duration of the Rental Period unless a purchase agreement is arranged and any associated purchase invoice paid in full.  
  • The Rental Fee, Security Bond and Return Postage* payments made for that specific product/s will be deducted from the purchase price.  
  • *If there are other rental products included in the Rental Agreement that the Renter wishes to return to Cloth and Carry at the end of the Rental Agreement period, the Return Postage will not be deducted from the purchase price.  
  • Postage fees paid in order to receive the rental equipment will not be credited towards the final payout invoice.  
  • Rental equipment will be charged according to the specific product’s age and how many times it has been hired previously. Brand new rental equipment will be charged at the retail price as listed on the Cloth and Carry website and recorded on the Baby Carrier Hire Agreement as the “Replacement Fee”. Deductions for age and prior use of the carrier are at the discretion of Cloth and Carry management.  

Support:  

  • All rental equipment will be acommpanied by an email containing videos and tips/tricks to ensure safety babywearing and ergonomic positioning.  
  • Cloth and Carry encourages all Renters to send through photos for a fit check on their first use/s for feedback: via email shop@clothandcarry.com.au or the Cloth and Carry Carrier Community group on Facebook.  

Ownership  

  • All rental equipment remains the property of Cloth and Carry until we relinquish ownership either:  
  • By an agreed sale to the Renter, with all invoices paid in full, or  
  • Following receipt of full payment for unreturned rental equipment 28 days after the end of the Rental Agreement. 

Termination:  

  • Cloth and Carry representatives reserve the right to terminate the Rental Agreement and reclaim the equipment if the Renter violates any terms or conditions outlined in this Agreement.  
  • Cloth and Carry representatives reserve the right to cancel and immediately refund a Rental Agreement in circumstances that are deemed to be high risk, or for repeat offenders of late returns.  

Privacy:  

In agreeance with the Cloth and Carry Privacy Policy, all customer information is stored securely and will not be shared with any third party outside of Shopify and any associated apps utilised by the organisation to maintain the website and its services, except where required by law.  

Governing Law:  

The Rental Agreement and its associated Terms and Conditions shall be governed by and construed in accordance with the laws of Australia.  

Disputes Resolution:  

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting Cloth and Carry directly.  

Updates to the Terms and Conditions:

All previous versions of terms and conditions for Cloth and Carry Baby Carrier Rental Services are null and void. A current copy of this policy is available on the website.

Entire Agreement:  

This Agreement, including the Agreement itself and these terms and conditions, constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.  

By renting baby carriers and accessories from Cloth and Carry, the Renter acknowledges that they have read, understood, and agreed to these terms and conditions.

Cloth and Carry’s Commitment to the Renter: 

We strive to provide baby carriers and babywearing accessories for hire that are:  

  • Suitable for the wearer and the child/ren 
  • Clean and in good working condition.  
  • Exclusively yours to use during the rental period. 

 

The Renter’s Obligations to Cloth and Carry: 

  • You are committed to wearing your baby safely, and within the manufacturer’s guidelines.  
  • You must look after all Cloth and Carry rental equipment with love and respect.  
  • Your Rental Agreement is individual to one household, is not transferable, and applies to all members of the Renter’s household.  
  • You must not allow or authorise any other person or entity to use, re-hire or have possession of any Cloth and Carry rental equipment at any time during the Rental Period.  
  • You must not be take Cloth and Carry rental equipment outside of Australia.  
  • Upon receipt of the rental equipment, you agree that you are satisfied that the items are in safe working condition and suitable for the purpose of hire.  
  • You agree to contact Cloth and Carry at the earliest convenience if the carrier is damaged, lost, or otherwise unsuitable for use.  
  • You agree to pay all outstanding charges and fees for lost or damaged items.
