Baby Carrier TBYB Service - Terms and Conditions

We want your Try Before You Buy (TBYB) experience to be simple, supportive and stress-free. Please read the following Terms & Conditions carefully - by hiring with Cloth and Carry you agree to these conditions.

Quick Overview (Plain English)

• You pay a hire fee + a security deposit.

• You trial your carrier for 2 weeks (from delivery date).

• Return it on time in good condition and your deposit is refunded.

• Or, choose to keep it and your hire fee + deposit are credited toward the purchase price.

• If not returned on time, late fees apply. If not returned within 28 days, the carrier will be charged at full RRP.

• You agree to use the carrier according to manufacturer's instructions and following TICKS guidelines.
• You agree to keep the carrier away from cigarette smoke, pet hair and strong fragrances.

1. Eligibility

• Must be 18+ and a resident of Australia.

• Maximum of two carriers can be hired at one time.

• Hire is for personal use only - not transferable, and not to be used outside Australia.

2. Rental Period

• Standard rental period is 14 calendar days from delivery (or collection).
  

3. Fees & Security Deposit

• Rental fee and security deposit of $100 must be paid in advance.

• Rental fee is non-refundable.

• Deposit is refunded once the carrier is returned on time and in good condition.

• If you decide to purchase, your rental fee and security deposit will be deducted from the retail price.

• Postage fees (to and from you) are not refundable or credited. If you decide to return the product, you will need to arrange and pay for return postage.

• Late fees: $5 per day.

4. Postage & Returns

• Renter pays tracked postage (including return postage if deciding to return the carrier) unless pre-arranged for collection from Mount Kuring-Gai, NSW.

• Carriers must be safely packaged and scanned into the Australia Post system (or returned in person) by the End Date.

• Tracking must be supplied if you arrange return postage yourself.

5. Late Returns

• $5/day late fee applies for every day past the End Date.

• After 28 days, the carrier is deemed unreturned and full RRP replacement cost will be charged.

• After 56 days, if payment is not made, Cloth and Carry may refer the matter to debt collection and/or police.

6. Care & Use

• You agree to use the carrier safely, following manufacturer instructions and T.I.C.K.S. babywearing guidelines.

• Carriers must not be exposed to cigarette smoke, pets, or strong fragrances.

• No animals may be carried in Cloth and Carry carriers.

• Do not modify, alter, or repair the carrier.

7. Cleaning

• Please do not wash the carrier unless instructed.

• If cleaning is required, you will receive written instructions.

• If washed without permission or returned unclean, a cleaning fee will be deducted.

• Suck pads (where included) must be returned - replacements will be charged at cost if missing.

8. Loss or Damage

• You are responsible for any loss, theft, or damage during the hire period.

• Repair or replacement costs (based on RRP) will be deducted from the deposit, and any balance must be paid within 10 business days.

• Carriers must be checked for stitching, buckles, and safety before each use.

9. Apply to Buy

• To keep your carrier, email shop@clothandcarry.com.au.

• Hire fee + security deposit will be credited to your purchase.

• Postage costs are not credited.

• Deposit will only be refunded (not credited) if other hire items are being returned.

10. Cancellations

• You may cancel before your hire begins.

• Hire fee is non-refundable, but deposit and postage will be refunded if the cancellation is made at least 7 days before dispatch.

• Cloth and Carry reserves the right to cancel and refund at our discretion.

11. Liability & Indemnity

• You hire and use carriers at your own risk.

• Cloth and Carry is not liable for any injury, accident, or damages arising from use, including advice given during fittings or recommendations.

• You indemnify Cloth and Carry and its representatives from any third-party claims related to misuse or breach of these terms.

12. Privacy & Communication

• Cloth and Carry will communicate with you via email or SMS regarding bookings, returns or fees.

• Please update us if your contact details change.

• Your data is stored securely in line with our Privacy Policy and will not be shared, except where required by law.

13. Governing Law & Disputes

• This Agreement is governed by the laws of New South Wales, Australia.

• Any disputes should first be raised directly with Cloth and Carry for informal resolution.

14. Entire Agreement

These Terms & Conditions, together with your Rental Agreement, form the entire agreement between you and Cloth and Carry and override all previous versions.
